BOARD OF HEALTH – PUBLIC SESSION


Minutes of the Meeting of August 8, 2012

Chairman Burton Kaplan called the meeting to order at 7:00 PM.

APPOINTMENTS
7:15 PM – Mary Wheatley – Title V Variance – 84 Captains Row.
Mary Wheatley of 84 Captains Row introduced herself to the Board.

Mrs. Wheatley commented that she spoke to Glen Harrington about a variance for her cesspool. Mrs. Wheatley stated that the Sloans, the buyers, have agreed to do the necessary work to upgrade the system so that she would be able to transfer the property to them.

Don Sloan stated that the closing date is scheduled for August 31, 2012. After this date Mr. Sloan plans on using this property as a rental property. Mr. Sloan was under the impression that a new septic system could be installed within the next year.

Glen Harrington stated that in cases where the house is demolished and rebuilt more time is given to install a new septic system. The Board allows 6 months for the installation. However, the length of time the Board grants for installation for an existing home is 3 months. The three months begins from the date of the closing in which the septic system has to be designed and installed with the Certificate of Compliance issued within that 90-day time frame.

The Sloans are claiming a financial hardship and cannot meet the 3-month deadline. Purchasing the property and then having to install a new Title V septic system, makes it difficult for them financially. The Sloans are planning on installing the new system in the spring.

Burton Kaplan stated that if the Board were to give the Sloans a 6-month time frame, the Board would be setting a precedent, and the Sloans would be obliged to meet that deadline. Since the Board is dealing with a financial hardship, it would be justification for allowing 3 additional months. Burton Kaplan stated that he and Kalliope Egloff are not in favor of extending the time frame beyond 6 months.

Kalliope Egloff made a motion that in regard to 84 Captains Row the Board of Health receive an Enforceable Agreement by August 15, 2012, engineering plans for a new septic system by October 10, 2012, and a new septic system is to be installed by February 20, 2013, and be notified when each of the deadlines are met. Burton Kaplan seconded the motion. The motion was unanimously approved.

 
NEW BUSINESS
1.   Sign Warrants.  Board members signed the warrant.

2.   Review/Approve BOH Public Session Minutes: July 25, 2012.
Review of the minutes was continued to the next BOH meeting with full Board member attendance.

3.   Emergency Dwelling Condemnation: 144 Wheeler Road.
Burton Kaplan stated that an order was issued July 31, 2012, condemning the dwelling at 144 Wheeler Road. It was also ordered to be immediately vacated.  Mr. Kaplan commented that he would like the Board of Health to reaffirm the order issued on July 31, 2012.

Glen Harrington commented that the property was vacant at the time of the inspection and is to remain vacant.

Kalliope Egloff made a motion that the Board of Health condemn 144 Wheeler Road in Mashpee as per the July 31, 2012, order. Burton Kaplan seconded the motion. The motion was unanimously approved.

DISCUSSION
1.   Household Hazardous Waste Day.
Kalliope Egloff stated that August 18, 2012, is the third Upper Cape Regional Household Hazardous Waste Collection at Mashpee High School. Ms. Egloff commented that the wait time in Falmouth was reduced from 1 ½ hours to 5 to 10 minutes by starting early and implementing some changes. She hopes to have the wait time at Mashpee High School for the Household Hazardous Waste Collection be comparable to 5 to 10 minutes.

Ms. Egloff commented that old gasoline, oil based paints, thinners, strippers, etc. will be accepted that day. The Household Hazardous Waste Collection ends at 1:00 PM. Cape Cod Cooperative Extension pays for the advertising in the Bourne, Falmouth, Sandwich, and Mashpee Enterprises.

Burton Kaplan declared a five minute recess at 7:10 PM because by law the Board is required to wait until the Agenda posted time. The meeting reconvened at 7:15 PM to discuss the issue of 84 Captains Row.

Kalliope Egloff made a motion that the Board of Health adjourn the meeting of August 8, 2012. Burton Kaplan seconded the motion. The motion was unanimously approved.

The public session meeting was adjourned at 7:31 PM.
